Limited Merits Review Consultation Draft Legislative and Regulatory Amendments (June 2013)

Under the National Electricity Laws and National Gas Laws, the Council was required to undertake a review of the limited merits review regime by 2015. On 9 December 2011, the former Standing Council on Energy and Resources agreed to bring the review of the limited merits review regime forward with a view to implementing consequent recommendations prior to the next round of regulatory determinations.

On 7 March 2012, Professor George Yarrow, Dr John Tamblyn and the Hon Michael Egan formed an Expert Panel tasked with conducting the review. The Expert Panel published its Final Report on 9 October 2012. Following the conclusion of the review, officials developed the Limited Merits Review of Decision-Making in the Electricity and Gas Regulatory Frameworks Decision Paper in June 2013 and commenced a consultation process on the consequent draft amendments to the National Electricity Laws and National Gas Laws, as well as the draft amendments to the Competition and Consumer Regulations 2012.

Stakeholders were invited to a public forum on the draft legislative and regulatory amendments in Melbourne on 28 June 2013. They were also invited to make written submissions by 12 July 2013. All stakeholders submissions received in response to this consultation process are available below, excluding where stakeholders clearly indicated that a submission should remain confidential, either in whole or in part.
